                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the escape of a child while an appeal is pending.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1. Chapter 56.  Section 56.03, Texas Family Code, is
    1-4  amended by adding Section 56.03 to read as follows:
    1-5        Section 56.03.  ESCAPE OF A CHILD.  When any escape from
    1-6  custody by the child occurs while said child has an appeal pending,
    1-7  the Texas Youth Commission or any Juvenile Detention Facility where
    1-8  the child was in custody shall immediately report the fact under
    1-9  oath to the district or county attorney of the county in which the
   1-10  judgment of adjudication or transfer was had.  Such report shall be
   1-11  sufficient evidence for the fact of such escape which shall
   1-12  authorize dismissal of the child's pending appeal.
   1-13        SECTION 2.  This Act takes effect on September 1, 1993.
   1-14        SECTION 3.  The importance of this legislation and the
   1-15  crowded condition of the calendars in both houses create an
   1-16  emergency and an imperative public necessity that the
   1-17  constitutional rule requiring bills to be read on three several
   1-18  days in each house be suspended, and this rule is hereby suspended.
