1-20 AN ACT
1-21 relating to the appointment of members to the Parks and Wildlife
1-22 Commission.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subchapter A, Chapter 11, Parks and Wildlife
1-25 Code, is amended by adding Section 11.003 to read as follows:
1-26 Sec. 11.003. GEOGRAPHIC REGIONS. The state is divided into
1-27 nine geographic regions from which the commission members are
1-28 appointed, as follows:
1-29 (1) Region 1: Archer, Armstrong, Bailey, Baylor,
1-30 Borden, Briscoe, Callahan, Carson, Castro, Childress, Clay,
1-31 Cochran, Collingsworth, Cooke, Cottle, Crosby, Dallam, Dawson, Deaf
1-32 Smith, Dickens, Donley, Eastland, Fisher, Floyd, Foard, Gaines,
1-33 Garza, Gray, Hale, Hall, Hansford, Hardeman, Hartley, Haskell,
1-34 Hemphill, Hockley, Hutchinson, Jack, Jones, Kent, King, Knox, Lamb,
1-35 Lipscomb, Lubbock, Lynn, Montague, Moore, Motley, Nolan, Ochiltree,
1-36 Oldham, Palo Pinto, Parker, Parmer, Potter, Randall, Roberts,
1-37 Scurry, Shackelford, Sherman, Stephens, Stonewall, Swisher, Taylor,
1-38 Terry, Throckmorton, Wheeler, Wichita, Wilbarger, Wise, Yoakum, and
1-39 Young counties;
1-40 (2) Region 2: Bowie, Camp, Cass, Collin, Delta,
1-41 Fannin, Franklin, Grayson, Gregg, Harrison, Henderson, Hopkins,
1-42 Hunt, Kaufman, Lamar, Marion, Morris, Panola, Rains, Red River,
1-43 Rockwall, Rusk, Smith, Titus, Upshur, Van Zandt, and Wood counties;
1-44 (3) Region 3: Andrews, Brewster, Coke, Coleman,
1-45 Concho, Crane, Crockett, Culberson, Ector, El Paso, Glasscock,
1-46 Howard, Hudspeth, Irion, Jeff Davis, Kimble, Loving, Martin,
1-47 McCulloch, Menard, Midland, Mitchell, Pecos, Presidio, Reagan,
1-48 Reeves, Runnels, Schleicher, Sterling, Sutton, Terrell, Tom Green,
1-49 Upton, Val Verde, Ward, and Winkler counties;
1-50 (4) Region 4: Bell, Bosque, Brown, Comanche, Coryell,
1-51 Dallas, Denton, Ellis, Erath, Falls, Hamilton, Hill, Hood, Johnson,
1-52 Lampasas, McLennan, Mills, Navarro, San Saba, Somervell, and
1-53 Tarrant counties;
1-54 (5) Region 5: Anderson, Angelina, Cherokee,
1-55 Freestone, Houston, Jasper, Leon, Limestone, Madison, Nacogdoches,
1-56 Newton, Polk, Sabine, San Augustine, San Jacinto, Shelby, Trinity,
1-57 Tyler, and Walker counties;
1-58 (6) Region 6: Bandera, Blanco, Comal, Edwards, Frio,
1-59 Gillespie, Kendall, Kerr, Kinney, Llano, Mason, Maverick, Medina,
1-60 Real, Uvalde, and Zavala counties;
1-61 (7) Region 7: Bastrop, Bexar, Brazos, Burleson,
1-62 Burnet, Caldwell, Fayette, Gonzales, Grimes, Guadalupe, Hays,
1-63 Karnes, Lee, Milam, Robertson, Travis, Washington, Williamson, and
1-64 Wilson counties;
1-65 (8) Region 8: Austin, Brazoria, Chambers, Colorado,
1-66 Fort Bend, Galveston, Hardin, Harris, Jackson, Jefferson, Lavaca,
1-67 Liberty, Matagorda, Montgomery, Orange, Waller, and Wharton
1-68 counties; and
2-1 (9) Region 9: Aransas, Atascosa, Bee, Brooks,
2-2 Calhoun, Cameron, DeWitt, Dimmit, Duval, Goliad, Hidalgo, Jim Hogg,
2-3 Jim Wells, Kenedy, Kleberg, La Salle, Live Oak, McMullen, Nueces,
2-4 Refugio, San Patricio, Starr, Victoria, Webb, Willacy, and Zapata
2-5 counties.
2-6 SECTION 2. Section 11.012, Parks and Wildlife Code, is
2-7 amended by adding Subsection (d) to read as follows:
2-8 (d) The governor shall appoint one commission member from
2-9 each geographic region designated under Section 11.003 of this
2-10 code.
2-11 SECTION 3. Subsection (a), Section 11.0125, Parks and
2-12 Wildlife Code, is amended to read as follows:
2-13 (a) It is a ground for removal from the commission if a
2-14 member:
2-15 (1) does not have at the time of appointment the
2-16 qualifications required by Section 11.0121 of this code for
2-17 appointment to the commission;
2-18 (2) does not maintain during the service on the
2-19 commission the qualifications required by Section 11.0121 of this
2-20 code for appointment to the commission;
2-21 (3) violates a prohibition established by Section
2-22 11.0122 or 11.0123 of this code;
2-23 (4) is unable to discharge his duties for a
2-24 substantial portion of the term for which he was appointed because
2-25 of illness or disability; <or>
2-26 (5) is absent from more than one-half of the regularly
2-27 scheduled commission meetings which the member is eligible to
2-28 attend during each calendar year, except when the absence is
2-29 excused by majority vote of the commission; or
2-30 (6) no longer resides in the geographic region from
2-31 which the member is appointed.
2-32 SECTION 4. Section 11.0125, Parks and Wildlife Code, is
2-33 amended by adding Subsection (d) to read as follows:
2-34 (d) A commission member's failure to reside in the
2-35 geographic region from which the member is appointed is not grounds
2-36 for removal of the member from the commission if the member no
2-37 longer resides in the geographic region because of a change in the
2-38 region's boundaries.
2-39 SECTION 5. (a) The governor shall make appointments under
2-40 Subsection (d), Section 11.012, Parks and Wildlife Code, as added
2-41 by this Act, as a vacancy occurs or a term expires for positions
2-42 held by those commission members serving on the effective date of
2-43 this Act.
2-44 (b) Subdivision (6), Subsection (a), Section 11.0125, Parks
2-45 and Wildlife Code, as added by this Act, applies only to a
2-46 commission member appointed under Subsection (d), Section 11.012,
2-47 Parks and Wildlife Code.
2-48 SECTION 6. The importance of this legislation and the
2-49 crowded condition of the calendars in both houses create an
2-50 emergency and an imperative public necessity that the
2-51 constitutional rule requiring bills to be read on three several
2-52 days in each house be suspended, and this rule is hereby suspended,
2-53 and that this Act take effect and be in force from and after its
2-54 passage, and it is so enacted.
