A BILL TO BE ENTITLED
AN ACT
1-1 relating to the consent of a person 17 years of age to donate blood
1-2 or blood components.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Chapter 162, Health and Safety Code, is amended
1-5 by adding Section 162.015 to read as follows:
1-6 Sec. 162.015. DONATION OF BLOOD BY PERSONS YOUNGER THAN 18
1-7 YEARS OF AGE. A person who is 17 years of age may consent to the
1-8 donation of the person's blood or blood components. A person
1-9 younger than 18 years of age may not receive any compensation from
1-10 a blood bank for a donation of the person's blood or blood
1-11 components.
1-12 SECTION 2. The heading to Chapter 162, Health and Safety
1-13 Code, is amended to read as follows:
1-14 CHAPTER 162. BLOOD BANKS AND DONATION OF BLOOD
1-15 SECTION 3. Subsection (a), Section 35.03, Family Code, is
1-16 amended to read as follows:
1-17 (a) A minor may consent to the furnishing of hospital,
1-18 medical, surgical, and dental care by a licensed physician or
1-19 dentist if the minor:
1-20 (1) is on active duty with the armed services of the
1-21 United States of America;
1-22 (2) is 16 years of age or older and resides separate
1-23 and apart from his parents, managing conservator, or guardian,
2-1 whether with or without the consent of the parents, managing
2-2 conservator, or guardian and regardless of the duration of such
2-3 residence, and is managing his own financial affairs, regardless of
2-4 the source of the income;
2-5 (3) consents to the diagnosis and treatment of any
2-6 infectious, contagious or communicable disease which is required by
2-7 law or regulation adopted pursuant to law to be reported by the
2-8 licensed physician or dentist to a local health officer or the
2-9 Texas Department of Health and including all sexually transmitted
2-10 diseases;
2-11 (4) is unmarried and pregnant, and consents to
2-12 hospital, medical, or surgical treatment, other than abortion,
2-13 related to her pregnancy; or
2-14 (5) <is 18 years of age or older and consents to the
2-15 donation of his blood and the penetration of tissue necessary to
2-16 accomplish the donation; or>
2-17 <(6)> consents to examination and treatment for
2-18 chemical addiction, chemical dependency, or any other condition
2-19 directly related to chemical use.
2-20 SECTION 4. This Act takes effect September 1, 1993.
2-21 SECTION 5. The importance of this legislation and the
2-22 crowded condition of the calendars in both houses create an
2-23 emergency and an imperative public necessity that the
2-24 constitutional rule requiring bills to be read on three several
2-25 days in each house be suspended, and this rule is hereby suspended.
