   1-17                         A BILL TO BE ENTITLED
   1-18                                AN ACT
   1-19  relating to the consent of a person 17 years of age to donate blood
   1-20  or blood components.
   1-21        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-22        SECTION 1.  Chapter 162, Health and Safety Code, is amended
   1-23  by adding Section 162.015 to read as follows:
   1-24        Sec. 162.015.  DONATION OF BLOOD BY PERSONS YOUNGER THAN 18
   1-25  YEARS OF AGE.  A person who is 17 years of age may consent to the
   1-26  donation of the person's blood or blood components.  A person
   1-27  younger than 18 years of age may not receive any compensation from
   1-28  a blood bank for a donation of the person's blood or blood
   1-29  components.
   1-30        SECTION 2.  The heading to Chapter 162, Health and Safety
   1-31  Code, is amended to read as follows:
   1-32            CHAPTER 162.  BLOOD BANKS AND DONATION OF BLOOD
   1-33        SECTION 3.  Subsection (a), Section 35.03, Family Code, is
   1-34  amended to read as follows:
   1-35        (a)  A minor may consent to the furnishing of hospital,
   1-36  medical, surgical, and dental care by a licensed physician or
   1-37  dentist if the minor:
   1-38              (1)  is on active duty with the armed services of the
   1-39  United States of America;
   1-40              (2)  is 16 years of age or older and resides separate
   1-41  and apart from his parents, managing conservator, or guardian,
   1-42  whether with or without the consent of the parents, managing
   1-43  conservator, or guardian and regardless of the duration of such
   1-44  residence, and is managing his own financial affairs, regardless of
   1-45  the source of the income;
   1-46              (3)  consents to the diagnosis and treatment of any
   1-47  infectious, contagious or communicable disease which is required by
   1-48  law or regulation adopted pursuant to law to be reported by the
   1-49  licensed physician or dentist to a local health officer or the
   1-50  Texas Department of Health and including all sexually transmitted
   1-51  diseases;
   1-52              (4)  is unmarried and pregnant, and consents to
   1-53  hospital, medical, or surgical treatment, other than abortion,
   1-54  related to her pregnancy; or
   1-55              (5)  <is 18 years of age or older and consents to the
   1-56  donation of his blood and the penetration of tissue necessary to
   1-57  accomplish the donation; or>
   1-58              <(6)>  consents to examination and treatment for
   1-59  chemical addiction, chemical dependency, or any other condition
   1-60  directly related to chemical use.
   1-61        SECTION 4.  This Act takes effect September 1, 1993.
   1-62        SECTION 5.  The importance of this legislation and the
   1-63  crowded condition of the calendars in both houses create an
   1-64  emergency and an imperative public necessity that the
   1-65  constitutional rule requiring bills to be read on three several
   1-66  days in each house be suspended, and this rule is hereby suspended.
