   1-23                         A BILL TO BE ENTITLED
   1-24                                AN ACT
   1-25  relating to the authority of the Texas School for the Blind and
   1-26  Visually Impaired to lease certain real property.
   1-27        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-28        SECTION 1.  Subchapter A, Chapter 11, Education Code, is
   1-29  amended by adding Section 11.09 to read as follows:
   1-30        Sec. 11.09.  LEASE OF CERTAIN PROPERTY OF TEXAS SCHOOL FOR
   1-31  THE BLIND AND VISUALLY IMPAIRED.  (a)  The Texas School for the
   1-32  Blind and Visually Impaired may lease available real property on
   1-33  the school's campus located at 1100 West 45th Street, Austin,
   1-34  Travis County, to a private, nonprofit corporation that provides
   1-35  print-handicapped persons with auditory materials.  The lease must
   1-36  provide that the corporation must use the property for those
   1-37  services.
   1-38        (b)  In determining the fair market consideration for the
   1-39  lease, actual benefits to be received by the school, the school's
   1-40  students, and the blind and visually impaired community in the
   1-41  state may be considered.
   1-42        (c)  The asset management division of the General Land Office
   1-43  shall negotiate the terms of the lease, determine the most suitable
   1-44  location for the lease, and close the transaction on behalf of the
   1-45  school as provided by Subchapter E, Chapter 31, Natural Resources
   1-46  Code.  The asset management division is not required to transact
   1-47  the lease by sealed bid or public auction.
   1-48        (d)  Proceeds from the real estate transaction conducted
   1-49  under this section shall be deposited in a separate account in the
   1-50  general revenue fund and appropriated to the Texas School for the
   1-51  Blind and Visually Impaired for the functions and purposes of the
   1-52  school as provided by Section 11.062 of this code.  This subsection
   1-53  is exempt from the application of Section 403.094(h), Government
   1-54  Code.
   1-55        SECTION 2.  The importance of this legislation and the
   1-56  crowded condition of the calendars in both houses create an
   1-57  emergency and an imperative public necessity that the
   1-58  constitutional rule requiring bills to be read on three several
   1-59  days in each house be suspended, and this rule is hereby suspended,
   1-60  and that this Act take effect and be in force from and after its
   1-61  passage, and it is so enacted.
