                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to access to a portion of the Devil's River in Val Verde
    1-2  County and directing the Texas Parks and Wildlife Department to
    1-3  generate a plan for river use in that segment of the river.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  The Texas Parks and Wildlife Department is hereby
    1-6  authorized and directed to develop and implement a plan for
    1-7  reasonable, recreational access to a portion of the Devil's River
    1-8  in Val Verde County located 1000 feet upstream from the river
    1-9  crossing of the right of way of State Highway 163, commonly called
   1-10  Baker's Crossing, to a point three miles downstream.
   1-11        SECTION 2.  The plan shall include provisions for:
   1-12        (a)  garbage receptacles and collection;
   1-13        (b)  limiting and avoiding conflicts with private property
   1-14  interests in and adjacent to the stream bed;
   1-15        (c)  law enforcement; and
   1-16        (d)  river safety.
   1-17        SECTION 3.  The Texas Parks and Wildlife Department shall
   1-18  hold public hearings on the proposed access plan in both Travis and
   1-19  Val Verde Counties.  Notice for the hearings shall be given at
   1-20  least thirty days in advance of the hearing by publication in at
   1-21  least two issues of a daily or weekly newspaper of general
   1-22  circulation in both Travis and Val Verde Counties and notice shall
   1-23  be given at least thirty days in advance to all private land owners
    2-1  who own property adjacent to the portion of river subject to this
    2-2  Act.  Notice to the land owner shall be deemed sufficient if made
    2-3  by certified mail to address of the property owner of record in the
    2-4  tax assessor collectors office in Val Verde County.
    2-5        SECTION 4.  The Texas Parks and Wildlife Department may
    2-6  promulgate rules and regulations to required to implement the plan.
    2-7  The Department may set and charge fees for river access in this
    2-8  portion of the river in order to offset any costs of implementing
    2-9  the plan.  Fees collected under this provision may not be used for
   2-10  any other operations of the Department.
   2-11        SECTION 5.  EMERGENCY.  The importance of this legislation
   2-12  and the crowded condition of the calendars in both houses create
   2-13  and emergency and an imperative public necessity that the
   2-14  constitutional rule requiring bills to be read on three several
   2-15  days in each house be suspended, and this rule is hereby suspended.
