                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the effective date of the federal operating permit
    1-2  program for air quality control in Texas.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter C, Chapter 382, Health and Safety
    1-5  Code, is amended by adding Section 382.064 to read as follows:
    1-6        Sec. 382.064.  INITIAL APPLICATION DATE.  An application for
    1-7  a federal operating permit is not required to be submitted to the
    1-8  board before the United States Environmental Protection Agency
    1-9  approves the Title V permitting program.
   1-10        SECTION 2.  Notwithstanding Section 2.35, Chapter 3, Acts of
   1-11  the 72nd Legislature, 1st Called Session, 1991, Sections 382.0541,
   1-12  382.0542, and 382.0561 through 382.0563, Health and Safety Code,
   1-13  and the federal operating permit requirement described by Section
   1-14  382.054, Health and Safety Code, take effect on the effective date
   1-15  of this Act.
   1-16        SECTION 3.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rule requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended,
   1-21  and that this Act take effect and be in force from and after its
   1-22  passage, and it is so enacted.
