No. 1218 By: Lucio 1-21 A BILL TO BE ENTITLED 1-22 AN ACT 1-23 relating to the effective date of the federal operating permit 1-24 program for air quality control in Texas. 1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-26 SECTION 1. Subchapter C, Chapter 382, Health and Safety 1-27 Code, is amended by adding Section 382.064 to read as follows: 1-28 Sec. 382.064. INITIAL APPLICATION DATE. An application for 1-29 a federal operating permit is not required to be submitted to the 1-30 board before the United States Environmental Protection Agency 1-31 approves the Title V permitting program. 1-32 SECTION 2. Notwithstanding Section 2.35, Chapter 3, Acts of 1-33 the 72nd Legislature, 1st Called Session, 1991, Sections 382.0541, 1-34 382.0542, and 382.0561 through 382.0563, Health and Safety Code, 1-35 and the federal operating permit requirement described by Section 1-36 382.054, Health and Safety Code, take effect on the effective date 1-37 of this Act. 1-38 SECTION 3. The importance of this legislation and the 1-39 crowded condition of the calendars in both houses create an 1-40 emergency and an imperative public necessity that the 1-41 constitutional rule requiring bills to be read on three several 1-42 days in each house be suspended, and this rule is hereby suspended, 1-43 and that this Act take effect and be in force from and after its 1-44 passage, and it is so enacted. 1-45 * * * * * 1-46 Austin, 1-47 Texas 1-48 May 3, 1993 1-49 Hon.
