No. 1255 A BILL TO BE ENTITLED AN ACT 1-1 relating to a deadline for teacher resignation from a term contract 1-2 without penalty. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter G, Chapter 21, Education Code, is 1-5 amended by adding Section 21.2071 to read as follows: 1-6 Sec. 21.2071. RESIGNATIONS. (a) A teacher employed under a 1-7 term contract with a school district may relinquish the teaching 1-8 position and leave the employment of the district at the end of a 1-9 school year without penalty by filing a written resignation with 1-10 the board of trustees of the district as provided by this 1-11 subsection. The resignation must be addressed to the board and 1-12 filed not later than the 45th day before the first day of the 1-13 following school year. A written resignation mailed by prepaid 1-14 certified or registered mail to the district is considered filed at 1-15 the time of mailing. 1-16 (b) A teacher employed under a term contract may resign, 1-17 with the consent of the board of trustees of the district employing 1-18 the teacher, at any other time mutually agreeable. 1-19 SECTION 2. This Act applies beginning with the 1993-1994 1-20 school year. 1-21 SECTION 3. The importance of this legislation and the 1-22 crowded condition of the calendars in both houses create an 1-23 emergency and an imperative public necessity that the 2-1 constitutional rule requiring bills to be read on three several 2-2 days in each house be suspended, and this rule is hereby suspended, 2-3 and that this Act take effect and be in force from and after its 2-4 passage, and it is so enacted.
