No. 1255 By: Zaffirini 1-20 A BILL TO BE ENTITLED 1-21 AN ACT 1-22 relating to a deadline for teacher resignation from a term contract 1-23 without penalty. 1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-25 SECTION 1. Subchapter G, Chapter 21, Education Code, is 1-26 amended by adding Section 21.2071 to read as follows: 1-27 Sec. 21.2071. RESIGNATIONS. (a) A teacher employed under a 1-28 term contract with a school district may relinquish the teaching 1-29 position and leave the employment of the district at the end of a 1-30 school year without penalty by filing a written resignation with 1-31 the board of trustees of the district as provided by this 1-32 subsection. The resignation must be addressed to the board and 1-33 filed not later than the 45th day before the first day of the 1-34 following school year. A written resignation mailed by prepaid 1-35 certified or registered mail to the district is considered filed at 1-36 the time of mailing. 1-37 (b) A teacher employed under a term contract may resign, 1-38 with the consent of the board of trustees of the district employing 1-39 the teacher, at any other time mutually agreeable. 1-40 SECTION 2. This Act applies beginning with the 1993-1994 1-41 school year. 1-42 SECTION 3. The importance of this legislation and the 1-43 crowded condition of the calendars in both houses create an 1-44 emergency and an imperative public necessity that the 1-45 constitutional rule requiring bills to be read on three several 1-46 days in each house be suspended, and this rule is hereby suspended, 1-47 and that this Act take effect and be in force from and after its 1-48 passage, and it is so enacted. 1-49 * * * * * 1-50 Austin, 1-51 Texas 1-52 April 22, 1993 1-53 Hon.
