S.B. No. 1324
                                        AN ACT
    1-1  relating to the provision by public institutions of higher
    1-2  education of information relating to the Texas academic skills
    1-3  program.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 51.306, Education Code, is amended by
    1-6  adding new Subsections (m), (n), and (p) and relettering the
    1-7  current Subsection (m) as Subsection (o) to read as follows:
    1-8        (m)(1)  A high school student who performs at or above a
    1-9  level on the Texas Assessment of Academic Skills test to be set by
   1-10  the board is exempt from this section.  This exemption will be in
   1-11  effect for three years from the date the Texas Assessment of
   1-12  Academic Skills test is taken and the set score level is achieved.
   1-13  Students enrolling for the first time in Texas public colleges and
   1-14  universities after the three-year period has elapsed must conform
   1-15  to all provisions of this section.
   1-16              (2)  Entering or transferring students who have
   1-17  achieved a score to be set by the board on the Scholastic
   1-18  Assessment Test or the American College Test are exempt from the
   1-19  requirements of this section.  This exemption will be in effect for
   1-20  five years from the date either the Scholastic Assessment Test or
   1-21  the American College Test is taken and the set standard is
   1-22  achieved.  Students enrolling for the first time in Texas public
   1-23  colleges and universities after the five-year period has elapsed
   1-24  must conform to all provisions of this section.
    2-1        (n)  The board shall adopt rules necessary for the
    2-2  administration of this subchapter.
    2-3        (o)  This section does not apply to a student located outside
    2-4  this state who enrolls in a course offered outside this state by an
    2-5  institution of higher education.
    2-6        (p)  An institution of higher education shall provide to each
    2-7  student under Subsection (b) of this section who is accepted by the
    2-8  institution for admission information in the institution's catalog
    2-9  relating to the testing and remedial requirements of this section
   2-10  and of the rules adopted by the Texas Higher Education Coordinating
   2-11  Board.
   2-12        SECTION 2.  Section 13.032, Education Code, is amended by
   2-13  adding Subsection (k) to read as follows:
   2-14        (k)  A person who has a composite score on the American
   2-15  College Test, the Scholastic Assessment Test, or a similar
   2-16  assessment test that is at or above a percentage set by the State
   2-17  Board of Education is not required to take the basic competency
   2-18  examination prescribed by the board as a condition to admission
   2-19  into an approved teacher education program under Subsection (e) of
   2-20  this section.
   2-21        SECTION 3.  Subsection (m), Section 51.306, and Subsection
   2-22  (k), Section 13.032, Education Code, as added by this Act, apply
   2-23  for admission to a public institution of higher education, as
   2-24  defined by Section 61.003, Education Code, on or after the
   2-25  beginning of the fall semester, 1993.
   2-26        SECTION 4.  The importance of this legislation and the
   2-27  crowded condition of the calendars in both houses create an
    3-1  emergency and an imperative public necessity that the
    3-2  constitutional rule requiring bills to be read on three several
    3-3  days in each house be suspended, and this rule is hereby suspended,
    3-4  and that this Act take effect and be in force from and after its
    3-5  passage, and it is so enacted.
