                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the ability of the Texas Water Development Board to
    1-2  obtain insurance and exempting Texas Water Development Board
    1-3  members and employees from personal liability relating to board
    1-4  business.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Subchapter D, Chapter 6, Water Code, is amended
    1-7  by adding Sections 6.108 and 6.109 to read as follows:
    1-8        Sec. 6.108.  POWER TO PURCHASE INSURANCE.  The board may
    1-9  purchase for its members, appointees, and employees and pay
   1-10  premiums on insurance of any type, including liability insurance,
   1-11  in any amounts and from any insurers the board considers advisable.
   1-12        Sec. 6.109.  LIABILITY.  Neither a member of the board nor
   1-13  any employee of the board is personally liable in the person's
   1-14  private capacity for any act performed or for any contract or other
   1-15  obligation entered into or undertaken in an official capacity in
   1-16  good faith and without intent to defraud in connection with the
   1-17  administration, management, or conduct of the board in its
   1-18  business, programs, or other related affairs.
   1-19        SECTION 2.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended,
    2-1  and that this Act take effect and be in force from and after its
    2-2  passage, and it is so enacted.
