                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the duties of the superintendent of a school district.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 13.351, Education Code, is amended by
    1-4  adding Subsection (c) to read as follows:
    1-5        (c)  The duties of the superintendent shall include:
    1-6              (1)  assuming administrative responsibility and
    1-7  leadership for the planning, operation, and evaluation of the
    1-8  education programs, services, and facilities of the district and
    1-9  for the annual performance appraisal of the district's staff;
   1-10              (2)  assuming administrative authority and
   1-11  responsibility for the assignment and evaluation of personnel of
   1-12  the district other than the superintendent and making
   1-13  recommendations regarding the selection, promotion, and dismissal
   1-14  of the personnel;
   1-15              (3)  managing the daily operation of the district as
   1-16  its chief executive officer;
   1-17              (4)  causing to be prepared a budget covering all
   1-18  estimated revenue and proposed expenditures of the district for the
   1-19  succeeding fiscal year, according to generally accepted accounting
   1-20  principles, the rules and regulations established by the State
   1-21  Board of Education, and policies adopted by the board of trustees,
   1-22  and in accordance with the provisions of Subchapter C, Chapter 23,
   1-23  Education Code;
    2-1              (5)  preparing recommendations for policies to be
    2-2  established by the board of trustees and overseeing the
    2-3  implementation of established policies;
    2-4              (6)  developing or causing the development of
    2-5  appropriate administrative regulations to implement policies
    2-6  established by the board of trustees;
    2-7              (7)  providing leadership for the attainment of student
    2-8  performance standards in the district based on the indicators
    2-9  adopted under Section 21.7531 of this code and other indicators
   2-10  adopted by the State Board of Education or the district's board of
   2-11  trustees; and
   2-12              (8)  performing any other duties assigned by the action
   2-13  of the board of trustees of the district.
   2-14        SECTION 2.  Section 23.43, Education Code, is amended to read
   2-15  as follows:
   2-16        Sec. 23.43.  DEPUTY BUDGET OFFICER.  To assist him in the
   2-17  professional and technical phases of budget preparation, the
   2-18  president of the board of trustees shall designate as deputy budget
   2-19  officer <the business manager, if any, of the district, or> the
   2-20  superintendent of schools; and if the district has no
   2-21  superintendent, the chief administrative employee of the district
   2-22  shall be designated as deputy budget officer.
   2-23        SECTION 3.  The importance of this legislation and the
   2-24  crowded condition of the calendars in both houses create an
   2-25  emergency and an imperative public necessity that the
    3-1  constitutional rule requiring bills to be read on three several
    3-2  days in each house be suspended, and this rule is hereby suspended,
    3-3  and that this Act take effect and be in force from and after its
    3-4  passage, and it is so enacted.
