                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the duties of the superintendent of a school district.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 13.351, Education Code, is amended by
    1-5  adding Subsection (c) to read as follows:
    1-6        (c)  The superintendent of each school district shall:
    1-7              (1)  administer and provide leadership for the
    1-8  planning, operation, and evaluation of the educational programs,
    1-9  services, and facilities of the district and for the annual
   1-10  performance appraisal of the district's staff;
   1-11              (2)  administer the assignment and evaluation of
   1-12  personnel of the district other than the superintendent and make
   1-13  recommendations regarding the selection, promotion, and dismissal
   1-14  of the personnel;
   1-15              (3)  manage the daily operations of the district as its
   1-16  chief executive officer;
   1-17              (4)  provide for preparing a budget covering all
   1-18  estimated revenue and proposed expenditures of the district for the
   1-19  succeeding fiscal year, according to generally accepted accounting
   1-20  principles, State Board of Education rules, and policies adopted by
   1-21  the board of trustees of the district;
   1-22              (5)  prepare recommendations for policies to be
   1-23  established by the board of trustees and oversee the implementation
   1-24  of established policies;
    2-1              (6)  develop or provide for the development of
    2-2  appropriate administrative rules to implement policies established
    2-3  by the board of trustees;
    2-4              (7)  provide leadership for attaining student
    2-5  performance standards in the district based on the indicators
    2-6  adopted under Section 21.7531 of this code and any other indicators
    2-7  adopted by the State Board of Education or the district's board of
    2-8  trustees; and
    2-9              (8)  perform any other duties assigned by the board of
   2-10  trustees of the district.
   2-11        SECTION 2.  Section 23.41, Education Code, is amended to read
   2-12  as follows:
   2-13        Sec. 23.41.  Budget Officer.  The superintendent <president
   2-14  of the board of trustees> of each independent school district
   2-15  whether created by general or special law shall be the budget
   2-16  officer for the district and, as such, shall have the duties
   2-17  prescribed in this subchapter.
   2-18        SECTION 3.  Section 23.42(a), Education Code, is amended to
   2-19  read as follows:
   2-20        (a)  On or before a date set by the State Board of Education,
   2-21  the superintendent of the district <president> shall prepare, or
   2-22  cause to be prepared, a budget covering all estimated revenue and
   2-23  proposed expenditures of the district for the next succeeding
   2-24  fiscal year.
   2-25        SECTION 4.  Section 23.43, Education Code, is amended to read
   2-26  as follows:
   2-27        Sec. 23.43.  Deputy Budget Officer.  To assist him in the
    3-1  professional and technical phases of budget preparation, the
    3-2  superintendent of the district <president of the board of trustees>
    3-3  shall designate as deputy budget officer the business manager, if
    3-4  any, of the district<, or the superintendent of schools; and if the
    3-5  district has no superintendent, the chief administrative employee
    3-6  of the district shall be designated as deputy budget officer>.
    3-7        SECTION 5.  Section 23.44, Education Code, is amended to read
    3-8  as follows:
    3-9        Sec. 23.44.  RECORDS AND REPORTS.  The superintendent of the
   3-10  district <president of the board of trustees> shall see to it that
   3-11  records are kept and that copies of all budgets, all forms, and all
   3-12  other reports are filed at the proper times and in the proper
   3-13  offices as required by subsequent sections of this subchapter.
   3-14        SECTION 6.  Section 23.45(a), Education Code, is amended to
   3-15  read as follows:
   3-16        (a)  When the budget has been prepared, the superintendent of
   3-17  the district shall give written notice of that fact to the
   3-18  president of the board of trustees.  The president shall call a
   3-19  meeting of the board of trustees, giving 10 days public notice and
   3-20  stating that the purpose of the meeting is the adoption of a budget
   3-21  for the succeeding fiscal year.
   3-22        SECTION 7.  The importance of this legislation and the
   3-23  crowded condition of the calendars in both houses create an
   3-24  emergency and an imperative public necessity that the
   3-25  constitutional rule requiring bills to be read on three several
   3-26  days in each house be suspended, and this rule is hereby suspended,
   3-27  and that this Act take effect and be in force from and after its
    4-1  passage, and it is so enacted.
