                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to the duties of a school district superintendent.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Section 13.351, Education Code, is amended by
    1-4  adding Subsection (c) to read as follows:
    1-5        (c)  The duties of the superintendent shall include:
    1-6              (1)  assuming administrative responsibility and
    1-7  leadership for the planning, operation, supervision, and evaluation
    1-8  of the education programs, services, and facilities of the district
    1-9  and for the annual performance appraisal of the district's staff;
   1-10              (2)  assuming administrative authority and
   1-11  responsibility for the assignment and evaluation of all personnel
   1-12  of the district other than the superintendent and making
   1-13  recommendations regarding the selection, promotion, and dismissal
   1-14  of such personnel, except as may be otherwise required by Section
   1-15  13.352 of this code;
   1-16              (3)  managing the day-to-day operations of the district
   1-17  as its chief executive officer;
   1-18              (4)  causing to be prepared a budget covering all
   1-19  estimated revenue and proposed expenditures of the district for the
   1-20  next succeeding fiscal year according to generally accepted
   1-21  accounting principles, the rules and regulations established by the
   1-22  State Board of Education, and policies adopted by the board of
   1-23  trustees;
    2-1              (5)  preparing recommendations for policies to be
    2-2  established by the board of trustees and overseeing the
    2-3  implementation of established policies;
    2-4              (6)  developing or causing the development of
    2-5  appropriate administrative regulations to implement policies
    2-6  established by the board of trustees;
    2-7              (7)  providing leadership for the attainment of student
    2-8  performance standards in the district based on the indicators
    2-9  established in Section 21.7531 of this code and other indicators as
   2-10  may be adopted by the State Board of Education or the district's
   2-11  board of trustees; and
   2-12              (8)  performing any other duties assigned by action of
   2-13  the board of trustees.
   2-14        SECTION 2.  Section 23.41, Education Code, is amended to read
   2-15  as follows:
   2-16        Sec. 23.41.  BUDGET OFFICER.  The <president of the> board of
   2-17  trustees of each independent school district whether created by
   2-18  general or special law shall designate the superintendent as <be>
   2-19  the budget officer for the district and, as such, the
   2-20  superintendent shall have the duties prescribed in this subchapter.
   2-21        SECTION 3.  Subsection (a), Section 23.42, Education Code, is
   2-22  amended to read as follows:
   2-23        (a)  On or before a date set by the State Board of Education,
   2-24  the superintendent <president> shall prepare, or cause to be
   2-25  prepared, a budget covering all estimated revenue and proposed
    3-1  expenditures of the district for the next succeeding fiscal year.
    3-2        SECTION 4.  Section 23.43, Education Code, is repealed.
    3-3        SECTION 5.  The importance of this legislation and the
    3-4  crowded condition of the calendars in both houses create an
    3-5  emergency and an imperative public necessity that the
    3-6  constitutional rule requiring bills to be read on three several
    3-7  days in each house be suspended, and this rule is hereby suspended,
    3-8  and that this Act take effect and be in force from and after its
    3-9  passage, and it is so enacted.
