1-20 A BILL TO BE ENTITLED
1-21 AN ACT
1-22 relating to the duties of the superintendent of a school district.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Section 13.351, Education Code, is amended by
1-25 adding Subsection (c) to read as follows:
1-26 (c) The duties of the superintendent shall include:
1-27 (1) assuming administrative responsibility and
1-28 leadership for the planning, operation, and evaluation of the
1-29 education programs, services, and facilities of the district and
1-30 for the annual performance appraisal of the district's staff;
1-31 (2) assuming administrative authority and
1-32 responsibility for the assignment and evaluation of personnel of
1-33 the district other than the superintendent and making
1-34 recommendations regarding the selection, promotion, and dismissal
1-35 of the personnel;
1-36 (3) managing the daily operation of the district as
1-37 its chief executive officer;
1-38 (4) causing to be prepared a budget covering all
1-39 estimated revenue and proposed expenditures of the district for the
1-40 succeeding fiscal year, according to generally accepted accounting
1-41 principles, the rules and regulations established by the State
1-42 Board of Education, and policies adopted by the board of trustees,
1-43 and in accordance with the provisions of Subchapter C, Chapter 23,
1-44 Education Code;
1-45 (5) preparing recommendations for policies to be
1-46 established by the board of trustees and overseeing the
1-47 implementation of established policies;
1-48 (6) developing or causing the development of
1-49 appropriate administrative regulations to implement policies
1-50 established by the board of trustees;
1-51 (7) providing leadership for the attainment of student
1-52 performance standards in the district based on the indicators
1-53 adopted under Section 21.7531 of this code and other indicators
1-54 adopted by the State Board of Education or the district's board of
1-55 trustees; and
1-56 (8) performing any other duties assigned by the action
1-57 of the board of trustees of the district.
1-58 SECTION 2. Section 23.43, Education Code, is amended to read
1-59 as follows:
1-60 Sec. 23.43. DEPUTY BUDGET OFFICER. To assist him in the
1-61 professional and technical phases of budget preparation, the
1-62 president of the board of trustees shall designate as deputy budget
1-63 officer <the business manager, if any, of the district, or> the
1-64 superintendent of schools; and if the district has no
1-65 superintendent, the chief administrative employee of the district
1-66 shall be designated as deputy budget officer.
1-67 SECTION 3. The importance of this legislation and the
1-68 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended,
2-4 and that this Act take effect and be in force from and after its
2-5 passage, and it is so enacted.
