  22-7          Amend S.B. No. 1345, Engrossed Printing, on page 15, between
  22-8    lines 12 and 13, by adding a new Subdivision (4) to added Section
  22-9    86.025(a), Parks and Wildlife Code, to read as follows and
 22-10    renumbering subsequent subdivisions appropriately:
 22-11                "(4)  will not cause erosion damage or other damage to
 22-12    riparian owners;".

 22-15          Amend S.B. No. 1345, Engrossed Printing, on page 15, between
 22-16    lines 16 and 17, by adding a new Subsection (c) to added Section
 22-17    86.025, Parks and Wildlife Code, to read as follows:
 22-18          (c)  The commission may not grant a lease under this chapter
 22-19    for any commercial dredging activity in the San Jacinto River in
 22-20    the segment of the river that reaches from a point immediately
 22-21    below Lake Houston Dam to the point at which the river joins the
 22-22    Houston Ship Channel.

 22-24                         COMMITTEE AMENDMENT NO. 4
 22-25          Amend S.B. 1345 as follows:
 22-26    On page 13, line 4, after EXEMPTIONS. add:  (a)
 22-27    On page 13 between lines 14 and 15 add the following:
  23-1          (b)  The commission by rule may exempt public utility
  23-2    maintenance dredging operations which are necessary to ensure
  23-3    continued use of waters under an existing water rights permit from
  23-4    the requirements of obtaining a permit.  Such operations shall be
  23-5    performed no more than once annually for no more than fifteen days
  23-6    per year.
