   1-21                         A BILL TO BE ENTITLED
   1-22                                AN ACT
   1-23  relating to the extraterritorial jurisdiction of certain
   1-24  municipalities.
   1-25        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-26        SECTION 1.  Subchapter Z, Chapter 42, Local Government Code,
   1-27  is amended by adding Section 42.904 to read as follows:
   1-28        Sec. 42.904.  EXCLUSION OF CERTAIN LAND FROM EXTRATERRITORIAL
   1-29  JURISDICTION OF MUNICIPALITY WITH POPULATION OF MORE THAN 1.5
   1-30  MILLION.  (a)  The extraterritorial jurisdiction of a municipality
   1-31  with a population of more than 1.5 million does not include any
   1-32  land that would not have been included in the municipality's
   1-33  extraterritorial jurisdiction but for the past or future annexation
   1-34  of a municipally owned airport, water reservoir, or lake, including
   1-35  adjacent lands, connected to the municipality by one or more
   1-36  annexed strips of land that are less than 500 feet in width and
   1-37  that include all or part of a roadway, canal, or other waterway.
   1-38        (b)  The municipality's boundaries surrounding the airport,
   1-39  water reservoir, or lake, including adjacent lands, along with the
   1-40  boundaries of any strip of land less than 500 feet in width
   1-41  connecting the same to the municipality, may not be taken into
   1-42  consideration in determining the municipality's extraterritorial
   1-43  jurisdiction, and the extraterritorial jurisdiction shall be
   1-44  determined as if the airport, water reservoir, lake, adjacent
   1-45  lands, and strips of land less than 500 feet in width had not been
   1-46  annexed.
   1-47        SECTION 2.  (a)  This Act takes effect September 1, 1993.
   1-48        (b)  If immediately before the effective date of this Act the
   1-49  extraterritorial jurisdiction of a municipality includes land
   1-50  described by Section 42.904, Local Government Code, as added by
   1-51  this Act, the boundaries of the extraterritorial jurisdiction are
   1-52  revised on the effective date of this Act to exclude that land.
   1-53        SECTION 3.  The importance of this legislation and the
   1-54  crowded condition of the calendars in both houses create an
   1-55  emergency and an imperative public necessity that the
   1-56  constitutional rule requiring bills to be read on three several
   1-57  days in each house be suspended, and this rule is hereby suspended.
