                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to performance of the duties of a county budget officer.
    1-2        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-3        SECTION 1.  Subsection (b), Section 111.062, Local Government
    1-4  Code, is amended to read as follows:
    1-5        (b)  A county that establishes the office of county budget
    1-6  officer may abolish that office only by a formal action of the
    1-7  commissioners court.  The court must take the action after the
    1-8  first day of the second month of the fiscal year and before the
    1-9  first day of the sixth month of the fiscal year.  If the office is
   1-10  abolished, <the county auditor shall immediately assume> the duties
   1-11  of budget officer shall be performed by:
   1-12              (1)  the county judge, if the county has a population
   1-13  of 225,000 or less; or
   1-14              (2)  the county auditor, if the county has a population
   1-15  of more than 225,000.
   1-16        SECTION 2.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rule requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended,
   1-21  and that this Act take effect and be in force from and after its
   1-22  passage, and it is so enacted.
