                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to performance of the duties of a county budget officer.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 111.062(b), Local Government Code, is
    1-5  amended to read as follows:
    1-6        (b)  A county that establishes the office of county budget
    1-7  officer may abolish that office only by a formal action of the
    1-8  commissioners court.  The court must take the action after the
    1-9  first day of the second month of the fiscal year and before the
   1-10  first day of the sixth month of the fiscal year.  If the office is
   1-11  abolished, <the county auditor shall immediately assume> the duties
   1-12  of budget officer shall be performed by:
   1-13              (1)  the county judge, if the county has a population
   1-14  of 225,000 or less; or
   1-15              (2)  the county auditor, if the county has a population
   1-16  of more than 225,000.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
