1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the creation of a game sanctuary along the Brazos River
1-22 in Palo Pinto and Parker counties; creating an offense and
1-23 providing a penalty.
1-24 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-25 SECTION 1. Chapter 82, Parks and Wildlife Code, is amended
1-26 by adding Subchapter M to read as follows:
1-27 SUBCHAPTER M. BRAZOS RIVER GAME SANCTUARY
1-28 Sec. 82.741. CREATION. All of the land area and public
1-29 water in that portion of the state-owned riverbed of the Brazos
1-30 River in Palo Pinto and Parker counties beginning at the Morris
1-31 Shepard Dam in Palo Pinto County is a game sanctuary.
1-32 Sec. 82.742. PROHIBITED ACTS. (a) Except as permitted
1-33 under Subsections (b) and (c) of this section, no person may
1-34 possess, shoot, or hunt with a firearm, bow and arrow, or crossbow
1-35 in the game sanctuary created under Section 82.741 of this code.
1-36 (b) Subsection (a) of this section does not apply to a peace
1-37 officer of this state, a law enforcement officer of the United
1-38 States, or a member of the armed forces of the United States or of
1-39 this state during the time that the officer or member is in the
1-40 actual discharge of official duties.
1-41 (c) Subsection (a) of this section does not apply to
1-42 waterfowl hunting on any reservoir owned, operated, or maintained
1-43 by a governmental entity now existing or to be constructed on the
1-44 Brazos River.
1-45 Sec. 82.743. PENALTY. A person who violates Section 82.742
1-46 of this code commits an offense that is a Class C Parks and
1-47 Wildlife Code misdemeanor.
1-48 SECTION 2. The importance of this legislation and the
1-49 crowded condition of the calendars in both houses create an
1-50 emergency and an imperative public necessity that the
1-51 constitutional rule requiring bills to be read on three several
1-52 days in each house be suspended, and this rule is hereby suspended,
1-53 and that this Act take effect and be in force from and after its
1-54 passage, and it is so enacted.
