A BILL TO BE ENTITLED
AN ACT
1-1 relating to the taxable value of property in certain school
1-2 districts.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Section 16.252, Education Code, is amended by
1-5 adding Subsection (f) to read as follows:
1-6 (f) For a school district that contracts for students
1-7 residing in the district to be educated in another district as
1-8 provided by Section 21.082 of this code, the taxable value of
1-9 property in the district is considered to be the taxable value of
1-10 property in the district determined under Section 11.86 of this
1-11 code minus the taxable value of property in the district that, if
1-12 multiplied by the tax rate under this section, raises an amount of
1-13 revenue equal to the total amount of tuition required to be paid
1-14 for the district's students under Section 21.082(b) of this code.
1-15 For a school district that contracts to educate students residing
1-16 in another district as provided by Section 21.082 of this code, the
1-17 taxable value of property in the district is considered to be the
1-18 taxable value of property in the district determined under Section
1-19 11.86 of this code plus the amount by which the taxable value of
1-20 property is reduced under this subsection for the district sending
1-21 students. If a school district contracts with more than one other
1-22 district to educate its students, the taxable value of property in
1-23 each district receiving students shall be increased proportionately
1-24 according to the percentage of those students that the district
2-1 receives.
2-2 SECTION 2. Section 16.503, Education Code, is amended to
2-3 read as follows:
2-4 Sec. 16.503. DEFINITION. (a) Except as provided by
2-5 Subsection (b) of this section, in <In> this subchapter, "taxable
2-6 value of property" is the value determined under Section 11.86 of
2-7 this code.
2-8 (b) "Taxable value of property" in a district that contracts
2-9 for students residing in the district to be educated in another
2-10 district or in a district that contracts to educate students
2-11 residing in another district, as provided by Section 21.082 of this
2-12 code, is the value determined under Section 16.252(f) of this code.
2-13 SECTION 3. This Act applies beginning with the 1993-1994
2-14 school year.
2-15 SECTION 4. The importance of this legislation and the
2-16 crowded condition of the calendars in both houses create an
2-17 emergency and an imperative public necessity that the
2-18 constitutional rule requiring bills to be read on three several
2-19 days in each house be suspended, and this rule is hereby suspended,
2-20 and that this Act take effect and be in force from and after its
2-21 passage, and it is so enacted.
