No. 1453 By: Sims 1-21 A BILL TO BE ENTITLED 1-22 AN ACT 1-23 relating to certain requirements for municipal utility districts 1-24 under Subchapter B, Chapter 54, Water Code. 1-25 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-26 SECTION 1. Section 54.016, Water Code, is amended by adding 1-27 Subsection (i) to read as follows: 1-28 (i) The orders, regulations, ordinances, or other duly 1-29 adopted requirements of a city in effect and applicable to a 1-30 district at the time the original petition for the creation of such 1-31 district is granted by the commission shall remain applicable to 1-32 the district and to all land and development within it until all 1-33 bonds issued by the district have been paid, regardless of the 1-34 annexation of the district or any part of it by the city. A city 1-35 shall, however, impose requirements to the extent specifically 1-36 required by federal or state law, rule, order, or permit 1-37 conditions. A city may not impose any requirement in conflict with 1-38 this section as a condition of its consent, and any provision in 1-39 conflict with this section in any consent or other agreement with 1-40 the city now existing or entered after the effective date of this 1-41 section shall be void and of no effect. 1-42 SECTION 2. The importance of this legislation and the 1-43 crowded condition of the calendars in both houses create an 1-44 emergency and an imperative public necessity that the 1-45 constitutional rule requiring bills to be read on three several 1-46 days in each house be suspended, and this rule is hereby suspended, 1-47 and that this Act take effect and be in force from and after its 1-48 passage, and it is so enacted. 1-49 * * * * * 1-50 Austin, 1-51 Texas 1-52 May 3, 1993 1-53 Hon.
