                                 A BILL TO BE ENTITLED
                                        AN ACT
    1-1  relating to reimbursement from the waste tire recycling fund for
    1-2  certain waste tire recyclers.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 361.477, Health and Safety Code, is
    1-5  amended by adding Subsection (f) to read as follows:
    1-6        (f)  Notwithstanding any other provision of this section, the
    1-7  Texas Water Commission may adopt rules to allow a waste tire
    1-8  recyler to be reimbursed from the waste tire recycling fund for the
    1-9  processing of tires that are recycled into other useful products or
   1-10  utilized in an energy recovery facility.  Before reimbursement is
   1-11  made to a waste tire recycler from the fund under these rules:
   1-12                          (i)  the waste tire recycler must render
   1-13  the tires environmentally inert;
   1-14                          (ii)  the end use must be determined to be
   1-15  a legal operation;
   1-16                          (iii)  the end use must be allowable under
   1-17  the rules and regulations of the State of Texas and/or the U.S.
   1-18  E.P.A.; and
   1-19                          (iv)  items i, ii and iii must be verified
   1-20  by the Commission.
   1-21        SECTION 2.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended,
    2-3  and that this Act take effect and be in force according to its
    2-4  terms, and it is so enacted.
