A BILL TO BE ENTITLED
AN ACT
1-1 relating to terms of office of members of the board of
1-2 commissioners of the Brazoria County Conservation and Reclamation
1-3 District Number Three.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 16, Chapter 307, Acts of the 61st
1-6 Legislature, Regular Session, 1969 (Article 8280-476, Vernon's
1-7 Texas Civil Statutes), is amended to read as follows:
1-8 Sec. 16. The <present> commissioners of the <drainage>
1-9 district <who shall become members of the board of commissioners of
1-10 the district on the effective date of this Act, or their
1-11 successors, shall hold office until January 1, 1971. Their
1-12 successors shall be elected at the next general election on the
1-13 first Tuesday after the first Monday in November, 1970, when there
1-14 shall be an election within the district for the election of the
1-15 successors of the members of the first board of commissioners.
1-16 Commissioners> shall <thereafter> be elected <every two years> at
1-17 the general election for county and state officers held on the
1-18 first Tuesday after the first Monday in November in even-numbered
1-19 years, and shall serve staggered four-year <two-year> terms with
1-20 the terms of two commissioners and one commissioner, alternately,
1-21 commencing on January 1 of the year following each <such> general
1-22 election.
1-23 SECTION 2. (a) The commissioners of the Brazoria County
1-24 Conservation and Reclamation District Number Three who are
2-1 presently serving as commissioners of the district shall hold
2-2 office until January 1, 1995.
2-3 (b) Notwithstanding Section 16, Chapter 307, Acts of the
2-4 61st Legislature, Regular Session, 1969 (Article 8280-476, Vernon's
2-5 Texas Civil Statutes), as amended by this Act, at the general
2-6 election held November 8, 1994, commissioners shall be elected to
2-7 hold place number one and place number three for four-year terms
2-8 and a commissioner shall be elected to hold place number two for a
2-9 two-year term. On expiration of the initial term, the term of the
2-10 commissioner elected to hold place number two is four years.
2-11 SECTION 3. The importance of this legislation and the
2-12 crowded condition of the calendars in both houses create an
2-13 emergency and an imperative public necessity that the
2-14 constitutional rule requiring bills to be read on three several
2-15 days in each house be suspended, and this rule is hereby suspended,
2-16 and that this Act take effect and be in force from and after its
2-17 passage, and it is so enacted.
