S.B. No. 1488 AN ACT 1-1 relating to the installation and repair of water well pumps and 1-2 equipment. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 32.009, Water Code, is amended by adding 1-5 Subsection (d) to read as follows: 1-6 (d) Notwithstanding Subsection (a) of this section, the 1-7 commission may not adopt rules under this chapter: 1-8 (1) regulating the installation or repair of well 1-9 pumps and equipment by a person who owns or is in control of 1-10 property or the person's employee or a person not hired or 1-11 compensated acting on the person's behalf on the property the 1-12 person owns or controls for the person's own use; or 1-13 (2) requiring a person who owns or is in control of 1-14 property or possesses a well to complete, repair, or retrofit the 1-15 well to any standard other than a standard in effect at the time 1-16 the well was originally completed unless the well is found to be a 1-17 threat to public health and safety or to water quality. 1-18 SECTION 2. Section 33.007, Water Code, is amended by adding 1-19 Subsection (d) to read as follows: 1-20 (d) Notwithstanding Subsection (a) of this section, the 1-21 commission may not adopt rules under this chapter: 1-22 (1) regulating the installation or repair of well 1-23 pumps and equipment by a person who owns or is in control of 1-24 property or the person's employee or a person not hired or 2-1 compensated acting on the person's behalf on the property the 2-2 person owns or controls for the person's own use; or 2-3 (2) requiring a person who owns or is in control of 2-4 property or possesses a well to complete, repair, or retrofit the 2-5 well to any standard other than a standard in effect at the time 2-6 the well was originally completed unless the well is found to be a 2-7 threat to public health and safety or to water quality. 2-8 SECTION 3. This Act takes effect September 1, 1993. 2-9 SECTION 4. The importance of this legislation and the 2-10 crowded condition of the calendars in both houses create an 2-11 emergency and an imperative public necessity that the 2-12 constitutional rule requiring bills to be read on three several 2-13 days in each house be suspended, and this rule is hereby suspended.
