1-19 A BILL TO BE ENTITLED
1-20 AN ACT
1-21 relating to the provision of utility service to certain political
1-22 subdivisions.
1-23 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-24 SECTION 1. Subsection (a), Section 51, Public Utility
1-25 Regulatory Act (Article 1446c, Vernon's Texas Civil Statutes), is
1-26 amended to read as follows:
1-27 (a) A public utility is not required to secure a certificate
1-28 of public convenience and necessity for:
1-29 (1) an extension into territory contiguous to that
1-30 already served by it and not receiving similar service from another
1-31 public utility and not within the area of public convenience and
1-32 necessity of another utility of the same kind;
1-33 (2) an extension within or to territory already served
1-34 by it or to be served by it under a certificate of public
1-35 convenience and necessity; <or>
1-36 (3) operation, extension, or service in progress on
1-37 the effective date of this Act; or
1-38 (4) the provision of service, on request, to a
1-39 political subdivision of the state created under Article XVI,
1-40 Section 59, of the Texas Constitution, which political subdivision
1-41 is located within the drainage area of the Colorado River basin
1-42 above the east line of Coleman County.
1-43 SECTION 2. The importance of this legislation and the
1-44 crowded condition of the calendars in both houses create an
1-45 emergency and an imperative public necessity that the
1-46 constitutional rule requiring bills to be read on three several
1-47 days in each house be suspended, and this rule is hereby suspended,
1-48 and that this Act take effect and be in force from and after its
1-49 passage, and it is so enacted.
