No. 46 SENATE CONCURRENT RESOLUTION 1-1 WHEREAS, State courts have a tremendous impact on the people 1-2 of Texas, and the performance of those courts has a profound effect 1-3 on how Texans view the judicial system; and 1-4 WHEREAS, Because the courts remain almost exclusively the 1-5 responsibility of local governments, the administration of justice 1-6 varies widely from county to county; and 1-7 WHEREAS, The Citizens' Commission on the Texas Judicial 1-8 System was established by the Supreme Court in 1991 to study and 1-9 recommend any necessary or desirable improvements in the courts of 1-10 Texas; and 1-11 WHEREAS, In its review of the Texas judicial system, the 1-12 commission discovered areas it believed should be accorded further 1-13 study by the legislature; now, therefore, be it 1-14 RESOLVED, That the 73rd Legislature of the State of Texas 1-15 hereby request the lieutenant governor and the speaker of the house 1-16 of representatives to create a joint committee to study the state 1-17 court system; and, be it further 1-18 RESOLVED, That, in carrying out its duties, the committee 1-19 shall study court facilities and security with the goal of 1-20 providing supplemental state funds to ensure that adequate 1-21 facilities and security be provided to every courtroom in the 1-22 state; the jurisdiction, procedure, fines, costs, administration, 1-23 facilities, and operation of the justice of the peace, municipal, 1-24 and small claims courts in the state; the fee structure of state 2-1 courts; and private process servers and their effect on the 2-2 official process service; and, be it further 2-3 RESOLVED, That the committee make a full report of its 2-4 findings and recommendations to the 74th Legislature when it 2-5 convenes in January, 1995; and, be it further 2-6 RESOLVED, That the committee's proceedings and operations be 2-7 governed by such general rules and policies for joint interim 2-8 committees as the 73rd Legislature may adopt and that such rules 2-9 and policies supersede the provisions of this resolution to the 2-10 extent of any conflict.
