No. 46 By: Montford 1-17 SENATE CONCURRENT RESOLUTION 1-18 WHEREAS, State courts have a tremendous impact on the people 1-19 of Texas, and the performance of those courts has a profound effect 1-20 on how Texans view the judicial system; and 1-21 WHEREAS, Because the courts remain almost exclusively the 1-22 responsibility of local governments, the administration of justice 1-23 varies widely from county to county; and 1-24 WHEREAS, The Citizens' Commission on the Texas Judicial 1-25 System was established by the Supreme Court in 1991 to study and 1-26 recommend any necessary or desirable improvements in the courts of 1-27 Texas; and 1-28 WHEREAS, In its review of the Texas judicial system, the 1-29 commission discovered areas it believed should be accorded further 1-30 study by the legislature; now, therefore, be it 1-31 RESOLVED, That the 73rd Legislature of the State of Texas 1-32 hereby request the lieutenant governor and the speaker of the house 1-33 of representatives to create a joint committee to study the state 1-34 court system; and, be it further 1-35 RESOLVED, That, in carrying out its duties, the committee 1-36 shall study court facilities and security with the goal of 1-37 providing supplemental state funds to ensure that adequate 1-38 facilities and security be provided to every courtroom in the 1-39 state; the jurisdiction, procedure, fines, costs, administration, 1-40 facilities, and operation of the justice of the peace, municipal, 1-41 and small claims courts in the state; the fee structure of state 1-42 courts; and private process servers and their effect on the 1-43 official process service; and, be it further 1-44 RESOLVED, That the committee make a full report of its 1-45 findings and recommendations to the 74th Legislature when it 1-46 convenes in January, 1995; and, be it further 1-47 RESOLVED, That the committee's proceedings and operations be 1-48 governed by such general rules and policies for joint interim 1-49 committees as the 73rd Legislature may adopt and that such rules 1-50 and policies supersede the provisions of this resolution to the 1-51 extent of any conflict. 1-52 * * * * * 1-53 Austin, 1-54 Texas 1-55 April 23, 1993 1-56 Hon.
