                             SENATE CONCURRENT RESOLUTION
    1-1        WHEREAS, Herman B. Taylor Construction Company alleges that:
    1-2        (1)  on November 1, 1988, Texas Southern University entered
    1-3  into a written contract with Herman B. Taylor Construction Company
    1-4  for the renovation of the E. O. Bell Building, Texas Southern
    1-5  University, in Houston;
    1-6        (2)  it fulfilled all of its obligations under the contract;
    1-7        (3)  Texas Southern University defaulted in the performance
    1-8  of its obligations under its contract with Herman B. Taylor
    1-9  Construction Company; and
   1-10        (4)  it is entitled to compensation for the financial damage
   1-11  suffered as a result of Texas Southern University's default of the
   1-12  contract; now, therefore, be it
   1-13        RESOLVED by the Legislature of the State of Texas, That
   1-14  Herman B. Taylor Construction Company is granted permission to sue
   1-15  the State of Texas and Texas Southern University subject to Chapter
   1-16  107, Civil Practice and Remedies Code; and, be it further
   1-17        RESOLVED, That the president of Texas Southern University be
   1-18  served process as provided by Subdivision (3), Subsection (a),
   1-19  Section 107.002, Civil Practice and Remedies Code.
