                                SENATE JOINT RESOLUTION
    1-1  proposing a constitutional amendment relating to the eligibility of
    1-2  certain public officers to seek election to and serve in the
    1-3  legislature.
    1-4        BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Article III, Section 19, of the Texas
    1-6  Constitution is amended to read as follows:
    1-7        Sec. 19.  (a)  If the <No> judge of any court of this state
    1-8  or a political subdivision of this state, the Secretary of State,
    1-9  the Attorney General, the clerk of any court of record of this
   1-10  state or a political subdivision of this state, or any person
   1-11  holding a lucrative office under this state other than a member of
   1-12  the Legislature announces his or her candidacy or in fact becomes a
   1-13  candidate in a general, special, or primary election for the
   1-14  Legislature, the announcement or candidacy constitutes an automatic
   1-15  resignation from that office, and the vacancy created shall be
   1-16  filled in the manner provided by law.  A person may not continue to
   1-17  perform the duties of an office covered by this subsection under
   1-18  Article XVI, Section 17, or any other law after the person
   1-19  announces his or her candidacy or in fact becomes a candidate in a
   1-20  general, special, or primary election for the Legislature.
   1-21        (b)  A person holding a lucrative office under the United
   1-22  States<, or this State,> or any foreign government is not <shall
   1-23  during the term for which he is elected or appointed, be> eligible
   1-24  to election to or service in the Legislature.  The ineligibility
    2-1  created by this subsection does not apply if the person resigns
    2-2  from or for any reason ceases to serve in the office.
    2-3        SECTION 2.  This proposed constitutional amendment shall be
    2-4  submitted to the voters at an election to be held November 2, 1993.
    2-5  The ballot shall be printed to provide for voting for or against
    2-6  the proposition:  "The constitutional amendment to provide that
    2-7  persons currently ineligible to the legislature because they hold
    2-8  certain public offices may become eligible to the legislature by
    2-9  resigning from or ceasing to hold office."
