A JOINT RESOLUTION
1-1 proposing a constitutional amendment to change the dedication of
1-2 revenues for highway and education purposes.
1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Article VIII, Section 7-a, of the Texas
1-5 Constitution is amended to read as follows:
1-6 Sec. 7-a. Subject to legislative appropriation, allocation
1-7 and direction, all net revenues remaining after payment of all
1-8 refunds allowed by law and expenses of collection derived from
1-9 motor vehicle registration fees, and all taxes, except gross
1-10 production and ad valorem taxes, on motor fuels and lubricants used
1-11 to propel motor vehicles over public roadways, shall be used for
1-12 the sole purpose of acquiring rights-of-way, constructing,
1-13 maintaining, and policing such public roadways, and for the
1-14 administration of such laws as may be prescribed by the Legislature
1-15 pertaining to the supervision of traffic and safety on such roads;
1-16 and for the payment of the principal and interest on county and
1-17 road district bonds or warrants voted or issued prior to January 2,
1-18 1939, and declared eligible prior to January 2, 1945, for payment
1-19 out of the County and Road District Highway Fund under existing
1-20 law; provided, however, that one-half <one-fourth (1/4)> of such
1-21 net revenue from the motor fuel tax shall be allocated to the
1-22 Available School Fund; and, provided, however, that the net revenue
1-23 derived by counties from motor vehicle registration fees shall
1-24 never be less than the maximum amounts allowed to be retained by
2-1 each County and the percentage allowed to be retained by each
2-2 County under the laws in effect on January 1, 1945. Nothing
2-3 contained herein shall be construed as authorizing the pledging of
2-4 the State's credit for any purpose.
2-5 SECTION 2. Article VIII, Section 7-b, of the Texas
2-6 Constitution is amended to read as follows:
2-7 Sec. 7-b. All revenues received from the federal government
2-8 as reimbursement for state expenditures of funds <that are
2-9 themselves dedicated> for acquiring rights-of-way and constructing,
2-10 maintaining, and policing public roadways may <are also
2-11 constitutionally dedicated and shall> be used <only> for any
2-12 purpose permitted by federal law <those purposes>.
2-13 SECTION 3. This proposed constitutional amendment shall be
2-14 submitted to the voters at an election to be held November 2, 1993.
2-15 The ballot shall be printed to provide for voting for or against
2-16 the proposition: "The constitutional amendment changing the
2-17 dedication of revenues for highway and education purposes."
