No. 31 By: Leedom 1-21 SENATE JOINT RESOLUTION 1-22 proposing a constitutional amendment relating to the duties of 1-23 trustees of local public pension systems. 1-24 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-25 SECTION 1. Article XVI, Section 67, of the Texas 1-26 Constitution is amended by adding Subsection (f) to read as 1-27 follows: 1-28 (f) Retirement Systems Not Belonging to a Statewide System. 1-29 The board of trustees of a system or program that provides 1-30 retirement and related disability and death benefits for public 1-31 officers and employees and that does not participate in a statewide 1-32 public retirement system shall: 1-33 (1) administer the system or program of benefits; 1-34 (2) hold the assets of the system or program for the 1-35 exclusive purposes of providing benefits to participants and their 1-36 beneficiaries and defraying reasonable expenses of administering 1-37 the system or program; and 1-38 (3) select legal counsel and an actuary and adopt 1-39 sound actuarial assumptions to be used by the system or program. 1-40 SECTION 2. This proposed constitutional amendment shall be 1-41 submitted to the voters at an election to be held November 2, 1993. 1-42 The ballot shall be printed to provide for voting for or against 1-43 the proposition: "The constitutional amendment providing that the 1-44 trustees of a local public pension system must administer the 1-45 system for the benefit of the system's participants and 1-46 beneficiaries." 1-47 * * * * * 1-48 Austin, 1-49 Texas 1-50 April 15, 1993 1-51 Hon.
