No. 1026 73R11373 LJD-D R E S O L U T I O N 1-1 BE IT RESOLVED by the Senate of the State of Texas, That Rule 1-2 12.03, Rules of the Senate, 73rd Legislature, is suspended, as 1-3 provided by Senate Rule 12.08, to the extent described in this 1-4 resolution, to enable the conference committee appointed to adjust 1-5 the differences between the house and senate versions of H.B. No. 1-6 259, relating to the creation and administration of a linked 1-7 deposit program to encourage lending to historically underutilized 1-8 businesses and small businesses in distressed communities, to 1-9 successfully conclude the committee's deliberations, by authorizing 1-10 the conferees to consider and take action on the following specific 1-11 matter: 1-12 (1) Senate Rule 12.03(1), is suspended to permit the 1-13 committee to insert "or a historically underutilized business" 1-14 before the period in Section 481.191(1), Government Code. 1-15 This action is necessary to clarify that a historically 1-16 underutilized business may be an eligible borrower for purposes of 1-17 a loan under the linked deposit program. 1-18 (2) Senate Rule 12.03(1) is suspended to permit the 1-19 committee to strike "historically underutilized businesses and 1-20 small businesses in distressed communities" in Section 481.193(a), 1-21 Government Code, and substitute "small businesses in distressed 1-22 communities and historically underutilized businesses". 1-23 This action is necessary to clarify that a historically 1-24 underutilized business is not required to be located in a 2-1 distressed community to participate in the program.
