                                   SENATE RESOLUTION
    1-1        BE IT RESOLVED by the Senate of the State of Texas, That Rule
    1-2  12.03, Rules of the Senate, 73rd Legislature, is suspended, as
    1-3  provided by Senate Rule 12.08, to the extent described in this
    1-4  resolution, to enable the conference committee appointed to adjust
    1-5  the differences between the House and Senate versions of H.B. No.
    1-6  1185, relating to purchasing by local governments, to successfully
    1-7  conclude the committee's deliberations by authorizing the conferees
    1-8  to consider and take action on the following specific matter:
    1-9        Senate Rule 12.03(1) is suspended to permit the committee to
   1-10  insert a new SECTION 17 to read as follows:
   1-11        SECTION 17.  Subsection (a), Section 19, The Texas
   1-12  Engineering Practice Act (Article 3271a, Vernon's Texas Civil
   1-13  Statutes), is amended to read as follows:
   1-14        Sec. 19.  (a)  It is unlawful for this State or for any of
   1-15  its political subdivisions, including any county, city, or town, to
   1-16  engage in the construction of any public work involving
   1-17  professional engineering, where public health, public welfare or
   1-18  public safety is involved, unless the engineering plans and
   1-19  specifications and estimates have been prepared by, and the
   1-20  engineering construction is to be executed under the direct
   1-21  supervision of a registered professional engineer.  However nothing
   1-22  in this Act shall be held to apply to any public work involving
   1-23  structural, electrical, or mechanical engineering wherein the
    2-1  contemplated expenditure for the completed project does not exceed
    2-2  Eight Thousand ($8,000.00) Dollars.  Nothing in this Act shall be
    2-3  held to apply to other public work wherein the contemplated
    2-4  expenditure for the completed project does not exceed Twenty
    2-5  Thousand ($20,000.00) Dollars.
    2-6        This action is necessary to clarify that a city need not
    2-7  engage the services of a registered professional engineer for a
    2-8  project that costs less than $20,000 and does not involve
    2-9  structural, mechanical, or electrical engineering.
