SENATE RESOLUTION
1-1 BE IT RESOLVED by the Senate of the State of Texas, That Rule
1-2 12.03, Rules of the Senate, 73rd Legislature, is suspended, as
1-3 provided by Senate Rule 12.08, to the extent described in this
1-4 Resolution, to enable the conference committee appointed to adjust
1-5 the differences between the House and Senate versions of S.B. No.
1-6 1051, relating to the reduction of solid waste by creating markets
1-7 for recycled materials otherwise promoting recycling and the use of
1-8 recycled materials and by municipal solid waste management, to
1-9 successfully conclude the committee's deliberations, by authorizing
1-10 the conferees to consider and take action on the following specific
1-11 matter:
1-12 (1) Senate Rule 12.03 is suspended to permit the committee
1-13 to insert a new Section 3, Subsection 361.472(a) to read as
1-14 follows:
1-15 (a) A wholesale or retail tire dealer who sells or offers to
1-16 sell new tires not for resale shall collect at the time and place
1-17 of sale a waste tire recycling fee <of $2> for each new
1-18 <automobile, van, bus, truck, trailer, semitrailer, truck tractor
1-19 and semitrailer combination, or recreational vehicle> tire sold as
1-20 follows:
1-21 (1) $2 for each tire with that has a rim diameter
1-22 <equal to or greater than> 12 inches but less than 17.5 <26>
1-23 inches; and
2-1 (2) $3.50 for each tire that has a rim diameter of
2-2 17.5 inches but less than 25 inches; and
2-3 (3) $2 for a motorcycle tire, regardless of the rim
2-4 diameter.
2-5 This action is necessary to compensate for the disparity
2-6 between the weight of a truck tire in comparison to an automobile
2-7 tire and the cost to the state for processing these tires.
