                                  R E S O L U T I O N
    1-1        BE IT RESOLVED by the Senate of the State of Texas, That Rule
    1-2  12.03, Rules of the Senate, 73rd Legislature, is suspended as
    1-3  provided by Senate Rule 12.08, to the extent described in this
    1-4  resolution, to enable the conference committee appointed to adjust
    1-5  the differences between the house and senate versions of S.B. 498,
    1-6  relating to the continuation, operations, and functions of the
    1-7  Public Utility Commission of Texas and the Office of Public Utility
    1-8  Counsel, to successfully conclude the committee's deliberations, by
    1-9  authorizing the conferees to consider and take action of the
   1-10  following specific matters:
   1-11        (1)  Senate Rules 12.03(1)-(4) are suspended to permit the
   1-12  committee to change, omit, and add language as necessary to provide
   1-13  for the creation, operation, and functions of separate electric and
   1-14  telecommunications divisions of the Public Utility Commission of
   1-15  Texas.
   1-16        Explanation:  This change is needed to allow independent
   1-17  regulation of electric and telecommunications utilities.
   1-18        (2)  Senate Rules 12.03(1)-(4) are suspended to permit the
   1-19  committee to change, omit, and add language as necessary to realign
   1-20  the powers and duties of the general counsel of the Public Utility
   1-21  Commission of Texas in a manner consistent with the operations of
   1-22  separate electric and telecommunications divisions.
   1-23        Explanation:  This change is necessary to clarify the powers
   1-24  and duties of the general counsel in regard to each of the
    2-1  divisions to be created.
    2-2        (3)  Senate Rules 12.03(1)-(4) are suspended to permit the
    2-3  committee to change, omit, and add language as necessary to provide
    2-4  for the regulation of electric utilities in a manner consistent
    2-5  with current law.
    2-6        Explanation:  This change is necessary to modify the
    2-7  regulation of electric utilities.
