BACKGROUND

Currently in the City of Pasadena several subdivisions' deed
restrictions have run out and there is no means by which they can
renew them.  The City of Houston addressed the problem in 1989 by
ordinance, but the City of Pasadena does not have zoning authority
and is unable to use that means.  Section 201.001(a) of the
Property Code provides a framework for the creation, extension,
renewal, and modification of deed restrictions, but it is bracketed
to apply only to a city with a population over 1,600,000 or to the
unincorporated areas of a county with a population over 2,400,000. 
Therefore, this section does not apply to the City of Pasadena.

PURPOSE

H.B. 18 will lower the population bracket from 1,600,000 to 100,000
allowing the City of Pasadena to be able to renew their deed
restrictions.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS

SECTION 1  Section 201.001(a), Property Code, is amended to change
           the population bracket from 1,600,000 to 100,000.

SECTION 2  Effective date:  September 1, 1995.

SECTION 3  Emergency clause.

SUMMARY OF COMMITTEE ACTION

H.B. 18 was considered by the committee in a public hearing on
April 4, 1995.

of Representatives Howard, Turner and Mowery.

After being recalled from subcommittee, the bill was considered by
the committee in a formal meeting on April 27, 1995.

The bill was reported favorably without amendment, with the
recommendation that it do pass and be printed and be sent to the
Committee on Local and Consent Calendars, by a record vote of 5
ayes, 0 nays, 0 pnv, 4 absent.
