BILL ANALYSIS H.B. 228 By: Dear (Sibley) State Affairs 05-24-95 Senate Committee Report (Unamended) BACKGROUND Article 2372dd-1, V.T.C.S., states that an automotive wrecking and salvage yard that is located within 1000 feet of a right-of-way must be screened by natural objects, fences, or other appropriate means so that it is not visible from the main-traveled way of the interstate or primary system. The law also sets forth height requirements for the wrecking and salvage yard. PURPOSE As proposed, H.B. 228 establishes a $100 minimum fine for violation of the 50-foot right-of-way requirement and for violations of certain screening requirements. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 7(a) and (b), Article 2372dd-1, V.T.C.S., to provide that an offense under this subsection is a misdemeanor punishable by a fine of not less than $100 and not more than $500, rather than a Class C misdemeanor. Makes a conforming change. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: 90 days after adjournment.
