BILL ANALYSIS H.B. 305 By: Park 02-24-95 Committee Report (Amended) BACKGROUND Currently Subchapter D of chapter 271, Texas Local Government Code allows local governments to purchase through the State Purchasing and General Services Commission without going through advertising for bids. Section 791.025, Texas Local Government Code provides that a local government may agree with another to purchase goods and services, but is silent as to advertisement and bidding. PURPOSE The purpose of this bill is to address the omission in Section 791.025, Texas Local Government Code to allow the advertising and bidding by one governmental entity to suffice for another when they are purchasing goods and services together. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1: Amends Article Section 791.025, Texas Local Government Code to allow that a local government that purchases goods and services under Sec. 791.025, Gov. Code, satisfies any state law requiring the local government to seek competitive bids for the purchase of the goods and services. SECTION 2: Emergency clause. EXPLANATION OF AMENDMENTS Committee amendment #1 amended line 13 of page 1 by striking "any state law requiring" and inserting "the requirement of". SUMMARY OF COMMITTEE ACTION HB 305 was considered by the Committee on County Affairs in a public hearing on 3/1/95. Craig Pardue, representing Dallas County, testified in favor of the bill. The committee considered one amendment. The amendment was adopted without objection. HB 305 was reported favorably as amended with the recommendation that it do pass and be printed, by a record vote of 6 Ayes, 0 Nays, 0 PNV, 3 Absent.
