Committee Report (Amended)

BACKGROUND

Currently Subchapter D of chapter 271, Texas Local Government Code
allows local governments to purchase through the State Purchasing
and General Services Commission without going through advertising
for bids.

Section 791.025, Texas Local Government Code provides that a local
government may agree with another to purchase goods and services,
but is silent as to advertisement and bidding.

PURPOSE

The purpose of this bill is to address the omission in Section
791.025, Texas Local Government Code to allow the advertising and
bidding by one governmental entity to suffice for another when they
are purchasing goods and services together.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

purchase of the goods and services.
