BILL ANALYSIS H.B. 305 By: Park (Harris) Intergovernmental Relations 4-6-95 Senate Committee Report (Unamended) BACKGROUND Chapter 271D, Local Government Code, allows local governments to purchase through the State Purchasing and General Services Commission without advertising for bids. Section 791.025, Government Code, provides that a local government may agree with another to purchase goods and services, but there is no provision regarding advertisement and bidding. PURPOSE As proposed, H.B. 305 provides that a contract for the purchase of goods and services by a local government with the state or a state agency satisfies the competitive bid requirement. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 791.025, Government Code, to provide that a local government that purchases goods and services under this section satisfies the requirement of the local government to seek competitive bids for the purchase of the goods and services. Makes a conforming change. SECTION 2. Emergency clause. Effective date: upon passage.
