BACKGROUND

Chapter 271D, Local Government Code, allows local governments to
purchase through the State Purchasing and General Services
Commission without advertising for bids.

Section 791.025, Government Code, provides that a local government
may agree with another to purchase goods and services, but there is
no provision regarding advertisement and bidding.

PURPOSE

As proposed, H.B. 305 provides that a contract for the purchase of
goods and services by a local government with the state or a state
agency satisfies the competitive bid requirement.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 791.025, Government Code, to provide that
a local government that purchases goods and services under this
section satisfies the requirement of the local government to seek
competitive bids for the purchase of the goods and services.  Makes
a conforming change.

SECTION 2. Emergency clause.
           Effective date: upon passage.
