BACKGROUND
A resident owning land in the New Caney Municipal Utility District
has requested service, and paid taxes, to the MUD for several
years.  Due to his geographical location, the MUD would charge
prohibitive and exorbitant fees to provide service.  The Board of
Directors of the MUD has decided that the taxpayer should be
excluded from the MUD.

PURPOSE 
To exclude land from the New Caney Municipal Utility District.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency, or institution.

SECTION BY SECTION ANALYSIS

     SECTION 1. Definition of district.

     SECTION 2. Describes excluded property in Montgomery County
Deed Records.

     SECTION 3. Continues the rights of bondholders.

     SECTION 4. Specifies continued obligation of landholder to
continue pro-rata share payments on existing bonds.

     SECTION 5. Emergency Clause.

SUMMARY OF COMMITTEE ACTION
HB 320 was considered by the committee in a public hearing on March
6, 1995.

recommendation that it do pass and be printed and that it be placed
on the Local and Consent Calendars, by a record vote of 5 ayes, 0
