BILL ANALYSIS H.B. 321 By: Rabuck (Nixon) State Affairs 05-09-95 Senate Committee Report (Unamended) BACKGROUND Currently, school buses may not exceed 50 miles per hour on interstate highways. The normal flow of traffic on interstate highways is at least 55 miles per hour. PURPOSE As proposed, H.B. 321 increases the legal speed limit for school buses on highways from 50 miles per hour to 55 miles per hour. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 166(a), Article 6701d, V.T.C.S. (Uniform Act Regulating Traffic on Highways), to provide that it is unlawful to exceed 55 miles per hour, rather than 50 miles per hour, for any school bus on an interstate highway, as defined by Section 144 of this Act, and 50 miles per hour for any school bus on another highway. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
