BILL ANALYSIS H.B. 330 By: Dear (Sibley) Criminal Justice 05-22-95 Senate Committee Report (Unamended) BACKGROUND Currently, a judge cannot refer a teenager to teen court without collecting state court costs. The program is supported by municipalities and school districts with no costs to the state. PURPOSE As proposed, H.B. 330 exempts a defendant referred to teen court from state court costs. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 45.55, Code of Criminal Procedure, by adding Subsection (g), to authorize a justice or municipal court to exempt a defendant for whom proceedings are deferred under this article from the requirement to pay a court cost or fee that is imposed by another statute. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
