BILL ANALYSIS H.B. 335 By: Uher February 23, 1995 Committee Report (Unamended) BACKGROUND The Board of Directors of the Sweeny Hospital District request that the filing date for office of Director be in compliance with § 144.005, subsection (a), of the Election Code of the State of Texas. At the present time, the last day to file for the hospital director is 25 days before the May general election. PURPOSE HB 335 will allow the Sweeny Hospital District to have the same filing deadline as other entities in Brazoria County, which is 45 days before the May general election. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3, Chapter 135, Acts of the 58th Legislature, Regular Session, 1963, to change the date of the regular election of directors from the first Saturday in April to the first Saturday in May. The candidate filing period is extended from 25 to 45 days before the election date. SECTION 2. Declares an emergency in order to suspend the rules requiring a bill be read on three separate days. SUMMARY OF COMMITTEE ACTION Pursuant to public notice posted on February 16, 1995, the Committee on County Affairs met in a public hearing on February 22,1995 to consider HB 335. The chair laid out HB 335 and recognized Representative Uher to explain the bill. Representative Uher explained the bill and closed. There was no testimony on HB 335. The motion that HB 335 be favorably reported to the full house with the recommendation that it do pass and be placed on the Local and Consent Calendar prevailed by the following vote: 8 Ayes, 0 Nays, 0 Present-not-voting, 1 Absent.
