BILL ANALYSIS H.B. 335 By: Uher (Patterson) Intergovernmental Relations 4-18-95 Senate Committee Report (Unamended) BACKGROUND The board of directors of the Sweeny Hospital District request that the filing date for the office of director be in compliance with Section 144.005(a), Election Code. Currently, the last day to file for the position of hospital director is 25 days before the May general election. PURPOSE As proposed, H.B. 335 amends provisions relating to the period for filing a petition for a place on the ballot for the board of directors of the Sweeny Hospital District. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 3, Acts of the 58th Legislature, Regular Session, 1963, as follows: Sec. 3. Requires a regular election of directors of the Sweeney Hospital District to be held on the first Saturday in May, rather than April, of each year and notice of such election to be published in a newspaper of general circulation in the county one time at least 10 days prior to the election. Requires a valid petition to be filed with a secretary no later than 5 p.m. of the 45th day before, rather than 25 days prior to, the date of election by any person desiring his or her name to be printed on the ballot as a candidate for director. SECTION 2. Emergency clause. Effective date: upon passage.
