BILL ANALYSIS H.B. 341 By: Kamel (Brown) State Affairs 5-25-95 Senate Committee Report (Unamended) BACKGROUND Currently, it is not unlawful to operate a motorized vehicle along a hike and bike trail. Homes along this area have become increasingly susceptible to crime. PURPOSE As proposed, H.B. 341 prohibits the use of motorized vehicles on hike and bike trials for purposes other than trail maintenance. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 13, Article 6701d, V.T.C.S., by adding Subsection (o), to define "hike and bike trail." SECTION 2. Amends Section 187, Article 6701d, V.T.C.S., as follows: Sec. 187. New heading: DRIVING UPON SIDEWALK OR HIKE AND BIKE TRAIL. (a) Prohibits any person from driving a motor vehicle upon a sidewalk, sidewalk area, or hike and bike trail except upon a permanent or duly authorized temporary driveway. (b) Provides that this section does not prohibit the operation of a motor vehicle on a hike and bike trail in connection with maintenance of the trial. SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause.
