BILL ANALYSIS H.B. 384 By: Junell (Montford) State Affairs 5-12-95 Senate Committee Report (Amended) BACKGROUND Currently, Railroad Commission oil field theft investigators are not eligible to retire and receive a service retirement annuity under Section 814.104, Government Code. PURPOSE As proposed, H.B. 384 includes employees of the Texas Railroad Commission who are licensed by the Commission on Law Enforcement Officer Standards and Education and who have served at least five years as an investigator for oil field theft detection division among persons eligible to retire and receive service retirement annuity. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 814.104(b), Government Code, to include among persons who are eligible to retire and receive service retirement annuity a person who is at least 55 years old and as an employee of the Railroad Commission of Texas who is licensed by the Commission on Law Enforcement Officer Standards and Education and has served at least five years as an investigator for the oil field theft detection division. SECTION 2. Amends Section 813.001, Government Code, to include equivalent membership service among types of service creditable in retirement system. SECTION 3. Amends Section 813.401, Government Code, to make a conforming change. SECTION 4. Amends Section 813.404, Government Code, to make a conforming change. SECTION 5. Effective date: September 1, 1995. SECTION 6. Emergency clause.
