BILL ANALYSIS H.B. 432 By: Jackson 03-06-95 Committee Report (Unamended) BACKGROUND In 1981, the legislature enacted HB 1311, establishing the La Porte Area Water Authority. The bill set Board representation at five members, one of which was to represent the unincorporated area within the new water authority's boundaries. Due to subsequent annexations, there is now no unincorporated land within the boundaries of the La Porte Area Water Authority; therefore, one position on the board remains vacant. That vacancy creates an even-numbered board membership. PURPOSE To eliminate the "unincorporated area representation" of the La Porte Area Water Authority. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 10, Chapter 729, Acts of the 67th Legislature, Regular Session, 1981, by striking subsections (b)-(c) and part of (d). Reletters the remaining subsections. SECTION 2. Emergency clause. SUMMARY OF COMMITTEE ACTION HB 432 was considered by the committee in a public hearing on March 6, 1995. No testimony was received. The bill was reported favorably without amendment with the recommendation that it do pass and be printed and that it be sent to the Local and Consent Calendars by a record vote of 6 ayes, 0 nays, 0 pnv, and 3 absent.
