BACKGROUND

Currently, Chapter 154.025, Local Government Code, prohibits
payments to persons owing a debt to the county in counties under
190,000 in population, and Chapter 154.045, Local Government Code
prohibits such payment in counties over 190,000. Chapter 154.045
was rewritten in 1989 to prohibit payment from any county fund.
However, Chapter 154.025 was not changed and prohibits only
payments made from the Officer Salary Fund.

PURPOSE

As proposed, H.B. 750 prohibits a warrant from being drawn on a
county fund in favor of a person until the person owing the debt is
notified that the debt is outstanding and the debt is paid.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 154.025, Local Government Code, as
follows:

     Sec. 154.025. New heading: DISBURSEMENTS TO PERSONS WITH
     OUTSTANDING DEBT PROHIBITED. Prohibits a warrant, if notice of
     indebtedness has been filed with the county auditor evidencing
     the indebtedness of a person to the state, the county, or a
     salary fund, from being drawn on a county fund in favor of a
     person, or an agent or assignee of a person, until the person
     owing the debt is notified that the debt is outstanding and
     the debt is paid. Deletes the provision prohibiting a warrant
     from being drawn on a salary fund in favor of a person, or an
     agent or assignee of a person who is indebted to the state,
     the county, or the salary fund.
     
     SECTION 2.     Effective date: September 1, 1995.

SECTION 3. Emergency clause.
